Letter of Renewal Fixed Term Contract

In line with the Protection of Employees( Fixed Term Work Act) 2003, if an employer proposes to renew a fixed-term contract, the employee should be informed in writing of the objective grounds:

  • justifying the renewal; and

  • explaining why a contract of indefinite duration is not being offered.

This needs to be done, at the latest, by the date of the renewal.

 Therefore, where school management proposes to re-employ a teacher on a fixed-term contract of employment, it is obliged to inform the teacher in writing of the objective grounds justifying the renewal of the fixed-term contract and the failure to offer a contract of indefinite duration.

 The objective ground, for example, for a teacher going into Year 2 of a fixed-term contract could be curricular concessions, replacing a teacher on career break or job-sharing. I attach a template letter which you can use and change to reflect the objective grounds for offering the fixed term contract.

 The school should inform payroll and complete the documentation certifying that the teacher was appointed to the position following advertisement and interview (Re-appointment Form). 

 This should be completed when schools have been advised that the Redeployment Process has completed for the relevant school year.
