Re: School Health Programme – Sharing of Personal Data with the HSE

The Department of Education have recently issued the following communications to all schools in relation to new Regulations concerning the School Health Programme:

  • Letter from the Chief Medical Officer advising the Department that the Minister for Health has signed the Infectious Diseases (Amendment) (No. 3) Regulations 2024 (SI 735 of 2024) and also signed the Health Provision of Information for Health Examination and Treatment Service) Regulations 2024 (SI 750 of 2024).

  • Letter from the Department of Education to schools advising of the new Regulations and the next steps to be taken. 

  • Note from the HSE to parents advising them of the details of the HSE's School Health Programme.

 

The Regulations provide that when such a request is made by the HSE, the school must provide the following personal data: 

  • the name, address, date of birth and sex of the pupil; 

  • the mother’s birth surname; 

  • full contact details of their parent/guardian; 

  • the pupil’s PPSN (if any); 

  • the name of the school which the pupil attends and the school roll number 

 

This is a significant change to the processing of personal data, and the legal bases for such processing, and in particular the sharing of personal data in schools.

In the letter from the Department of Education to schools you will see they are advising of an update to your school privacy notice to reflect these changes. ACCS has updated the template Data Protection Policy to reflect this change, and the new template is attached to this information bulletin and is also available on our website.
